The lawyer called. The woman we were buying from actually had a lein on the property which would have been fine if our down payment had covered it but it was more than our down payment and we could have still done it but if she had decided not to pay it, they could have foreclosed on it and there would have been nothing we could do.
We got our money back.
Depressing.
However! Must mean something better will come up : /

They made me another offer of $3000 more down payment and they would take just $4000 off the original price but I didn't feel I could trust them any more plus the property was not really worth that much. She should have come down a lot more on the price under that situation but she is a bit greedy.
DeleteHang on and give it another shot in 30 to 45 days...make a lower offer and write in the contract lien monies to be held in escrow and be paid out to lien holder at the close of sale...the seller never touches the money. It's amazing how quickly a seller regrets being greedy once they lose a good buyer...they don't like watching all that money walk away. Can you tell I'm a real estate broker...damnable good one, too! :)
ReplyDeleteYeah the lawyer actually told us that we were the third buyer to do this to. I am not sure I would trust her with owner financing anyway since I would be paying directly to her. We might make her an offer later but it will be much lower. They want a lot for what is on the property anyway but we were willing to pay it because it was owner financing but not willing to lose it. She called me and asked me if I would be willing to put a down payment of $3000 more to pay off their lein but they were only willing to go down on the price of the place by $4000. Which might seem like a deal but the taxes only value it at $13,700 something and we were going to pay $29,000. Anyway, I really hate this and am glad the lawyer was so honest and decent. Trust me, if I EVER need a lawyer it will be this one.

ReplyDeleteOh this wasn't a lot of land. Just an acre or so but it was set up nice for what I would want. Garden already fenced, large cement minnow tank that I could use to raise fish in, small pond-not quite finished....so much potential.
